Peg Leg Productions LLC filed a lawsuit in St. Clair County, Illinois alleging a massive conspiracy of individuals hacking into its website, Peg Leg Productions LLC v Charter Communications LLC 13 MR 0142. The same attorneys representing Peg Leg Productions LLC represent LW Systems LLC, which filed an earlier, similar lawsuit in St. Clair County, Illinois with nearly identical allegations.  (LW Systems LLC v Christopher Hubbard, 13-L-15). Numerous motions have been filed including motions to recuse the judge and to change venue, according to the St. Clair County Circuit Court website.

Our firm presented motions to quash subpoenas in the LW Systems LLC matter in St. Clair County, and may be asked to file motions to quash subpoenas in the Peg Leg Productions matter. 

Just as in the LW Systems, LLC case, we expect the Peg Leg Productions LLC case will be one with a great deal of activity. These cases have shared legal representation in the federal Ingenuity 13 case which resulted in an extraordinary sanctions order, now referred to as the "Star Trek Order" due to Judge Otis Wright's many references to Start Trek in the order. 

WHAT IS THE PEG LEG PRODUCTIONS CASE ABOUT?

The Peg Leg Productions LLC case appears to make similar, but not the same, allegations as the LW Systems LLC, Guava LLC, and Arte de Oaxaca cases. At this point in time, the LW Systems LLC case appears to allege a conspiracy of individuals hacking computer systems in order to access adult movies on a paid website(s).

We have no reliable facts at this point in time, as there has been little to no court-ordered discovery to obtain documents, depositions, etc. If the Peg Leg Productions LLC case is anything like the LW Systems LLC case, IP addresses that receive notices of subpoenas may have merely been used in file-sharing using BitTorrent software. If this is the case, it does not mean that Peg Leg Systems LLC has a legal case against these persons for merely using BitTorrent to file-share movies, as no copyright infringement claims by Peg Leg Productions have been made.

As with other peer-to-peer file-sharing cases, we will continue to follow the Peg Leg Productions and LW Systems LLC case intensely to advise our clients.
