Guava LLC cases: Filed in St. Clair County, Illinois, (Guava LLC v Comcast Cable, 12-MR-417) and in Hennepin County, Minnesota (Guava LLC v Spencel Merkel, 27-cv-12-20976) Update: Cook County Guava, LLC case dismissed
The Guava, LLC cases are similar to the Arte de Oaxaca case, basically alleging a conspiracy of individuals hacked into computer systems in order to access adult movies on a paid website(s). The following is not intended to be legal advice. Seek competent legal counsel for your specific situation.
We have no reliable facts at this point in time, as there has been little to no publicly available court-ordered discovery to obtain documents, depositions, etc. Speculation exists that IP addresses receiving notices of subpoenas in the Guava, LLC cases may have merely been used in file-sharing using BitTorrent software.
If this is the case, it does not mean that Guava, LLC cases has a legal case against those persons merely for using BitTorrent to file-share movies. It remains to be seen if Guava, LLC will better articulate their claims (just as with the Arte de Oaxaca and LW Systems LLC cases). As with other peer-to-peer file-sharing cases, we will continue to follow the Guava, LLC cases intensely to advise our clients.
